    Article 12 The competent departments of industry and informatization at all levels shall, based on the state of industrial energy consumption and the development of industrial economy, study and propose the total industrial energy consumption control targets and energy conservation targets in their respective administrative areas, and implement target management.

    Article 15 The competent departments of industry and informatization at all levels shall establish education and training mechanisms for industrial energy-saving management personnel and professional and technical personnel, formulate educational training plans and outlines, and organize special education and job training.

    Departments of industry and information technology at all levels shall carry out industrial energy conservation publicity activities and actively publicize industrial energy conservation policies and regulations, energy conservation technologies and advanced experience.

    Article 16 The competent departments of industry and informatization at all levels shall cultivate the development of energy-saving service industries, support energy-saving service agencies to carry out industrial energy-saving consulting, design, evaluation, measurement, testing, audit, certification and other services, and actively promote contract energy management and energy-saving equipment Energy-saving mechanisms such as leasing, government and social capital cooperation models, and voluntary energy-saving agreements.     The competent departments of industry and informatization at all levels shall clarify the key tasks of the annual industrial energy-saving supervision, and organize energy-saving supervision institutions to carry out joint inspections and remote inspections as needed.

    The Ministry of Industry and Information Technology may entrust local energy-saving supervision agencies to carry out relevant special supervision tasks as required.

    Article 20 Industrial energy-saving supervision shall mainly take the form of on-site supervision, and may take the form of written supervision when necessary.     Article 23 An industrial enterprise shall set up measurable and assessable annual energy-saving indicators, improve the system of rewards and punishments for energy-saving goals, clarify job target responsibilities, and strengthen incentives and constraints.

    Article 24 Industrial enterprises implement classified measurement of various types of energy consumption, reasonably equip and use energy measurement instruments that conform to national standards, improve basic energy measurement capabilities, and ensure that the original data are true, accurate, and complete.

    Article 25 An industrial enterprise shall identify energy statisticians, establish and improve original energy records and statistical ledger, strengthen energy data collection management, and submit relevant statistical data and information in accordance with regulations.

    Article 26 Industrial enterprises shall strictly implement the compulsory standards such as national energy efficiency equipment (product) energy efficiency standards and unit product energy consumption quota standards, and prohibit the purchase, use, and production of energy consumption equipment (products) explicitly eliminated by the state. The energy-use technology, equipment (products) eliminated by the state explicitly are transferred or leased for use by others.

    Article 27 Encourage industrial enterprises to strengthen energy-saving technology innovation and technological transformation, conduct research on energy-saving technology applications, develop key technologies for energy-saving, promote the transformation of energy-saving technological achievements, and adopt efficient energy-saving processes, technologies, and equipment (products).

    Encourage industrial enterprises to create "green factories", develop and apply technologies such as smart microgrids, distributed photovoltaic power generation, waste heat and pressure utilization, and green lighting, and develop and use green, clean, and low-carbon energy.

    Article 28. Industrial enterprises shall regularly conduct publicity and education on energy-saving policies and regulations and technical training for their employees.

    Chapter V Energy Saving of Key Energy-using Industrial Enterprises

    Article 29 Strengthen energy-saving management of key energy-consuming industrial enterprises. Key energy-using industrial companies include:

    (1) Industrial enterprises with a total annual energy consumption of 10,000 tons of standard coal (equivalent to 80 million kilowatt-hours of electricity, 6800 tons of diesel, or 7.6 million cubic meters of natural gas);

    (2) Total annual energy consumption of 5,000 tons of standard coal (respectively equivalent to 40 million kilowatt-hours of electricity, 3400 tons of diesel or 3.8 million cubic meters of natural gas) as determined by the provincial, autonomous region, and municipality ’s industry and information technology authorities is less than one Industrial enterprise of 10,000 tons of standard coal.

    Article 30 The Ministry of Industry and Information Technology strengthens guidance and supervision on energy conservation management of key energy-using industrial enterprises nationwide.

    Article 31 Key energy-consuming industrial enterprises shall set up energy statistics, metering, technology, and comprehensive management positions based on the total energy consumption, the concentration of production sites, and the complexity of production processes. The senior management personnel of the above technical titles are responsible for energy management, forming an energy management organization system with posts, responsibilities and full participation.

    The establishment of energy management posts and the appointment of the person in charge of energy management of key energy-using industrial enterprises shall be reported to the relevant industrial and information administration departments for the record.

    Article 32 Encourage key energy-using industrial enterprises to carry out energy audits, and formulate energy-saving plans and energy-saving technological transformation plans for enterprises based on the audit results, and track and implement the implementation of energy-saving transformation projects.

    Article 33 The key energy-using industrial enterprises shall submit the energy utilization status report of the previous year to the relevant industrial and informatization authorities. Energy utilization status report includes energy purchase, processing, conversion and consumption, unit product energy consumption, energy consumption of major energy-consuming equipment and processes, energy efficiency, energy management, energy-saving measures, energy-saving benefit analysis, completion of energy-saving targets, and energy Consumption forecasts and more.

    Article 34 If the key energy-consuming industrial enterprises are unable to achieve the annual energy-saving targets, the relevant industrial and informatization competent authorities shall notify them.

    Article 35 Key energy-consuming industrial enterprises shall actively fulfill their social responsibilities, and encourage key energy-consuming industrial enterprises to regularly release corporate social responsibility reports that include energy use, energy conservation management, and employee care.

    Article 36 The key energy-consuming industrial enterprises shall carry out activities of benchmarking and achieving energy efficiency standards, establish energy efficiency benchmarks, formulate implementation plans, improve energy conservation management, implement major energy-saving technological transformation projects, and strive to create energy efficiency “leaders”.

    Article 37 Encourage key energy-using industrial enterprises to build an energy management and control center system, use automation and information technology to implement dynamic monitoring and management of the production, transmission, distribution and consumption of enterprise energy systems, improve and optimize energy balance, and increase corporate energy Utilization efficiency and management level.

    Article 38 Key energy-consuming industrial enterprises shall establish an energy management system, adopt advanced energy-saving management methods and technologies, improve the management of the entire process of energy utilization, and promote the construction of energy-saving culture in enterprises.

    Chapter VI Legal Liability

    Article 39. The competent authorities of industry and information technology at all levels and relevant departments shall, in accordance with their functions and powers, order industrial enterprises in any of the following circumstances to be ordered to make corrections within a specified period of time and to be suspended according to laws and regulations such as the Energy Conservation Law of the People's Republic of China Equipment, warnings, fines, etc., and made public:

    (1) The energy consumption does not meet the mandatory energy consumption quotas and energy efficiency standards;

    (2) Energy statistics and energy measurement do not meet the relevant national requirements;

    (3) Fraudulent energy data;

    (4) producing and using high energy-consuming and backward energy-using products, equipment and processes eliminated by the state's explicit order;

    (5) Other situations in violation of energy conservation laws and regulations.

    Article 40 Staff members of the competent industrial and information technology departments at all levels and energy-saving supervision agencies shall be punished according to law if they have one of the following circumstances in the management of industrial energy-saving; if they constitute a crime, they shall be investigated for criminal responsibility according to law:

    (1) Disclosure of the company's technical secrets or business secrets;

    (2) Making use of the convenience of his position to seek illegal benefits;

    (3) Collecting fees illegally;

    (4) Those who abuse their powers, neglect their duties, and engage in malpractices for personal gain.

    Chapter VII Supplementary Provisions

    Article 41 The competent departments of industry and informatization of local people's governments at or above the county level may formulate specific implementation measures based on these measures and local conditions.
