Article 2 The term "industrial energy conservation" referred to in these Measures refers to the implementation of basic national policies to conserve resources and protect the environment in the industrial field, to strengthen industrial energy management, to adopt measures that are technically feasible, economically reasonable, and environmentally and socially sustainable. Article 3 These measures apply to the supervision and management of energy use and energy conservation in the industrial sector within the territory of the People's Republic of China.
Article 4 The Ministry of Industry and Information Technology is responsible for national industrial energy conservation supervision and management, organizes the formulation of industrial energy strategies and plans, total energy consumption control and energy conservation goals, energy conservation policies and standards, and organizes and coordinates new industrial energy conservation technologies, new products, and new equipment 2. Promotion and application of new materials, guidance and organization of industrial energy conservation supervision.
The competent departments of industry and informatization of local people's governments at or above the county level are responsible for the supervision and management of industrial energy conservation within their respective administrative areas.
Article 5 An industrial enterprise is the main body of industrial energy conservation. It shall strictly implement energy conservation laws, regulations, rules and standards, accelerate the progress of energy conservation technology, improve the energy conservation management mechanism, improve energy efficiency, and accept the energy conservation supervision and management of the competent department of industry and information technology.
Article 6: Social associations and other social organizations are encouraged to play an active role in industrial energy-saving planning, the formulation and implementation of energy-saving standards, the promotion of energy-saving technologies, energy consumption statistics, energy-saving publicity and training, and information consultation, as well as the achievement of energy efficiency standards.

Article 7 The competent departments of industry and informatization at all levels shall compile and organize the implementation of industrial energy-saving plans or action plans.
Article 8 The competent departments of industry and informatization at all levels should strengthen the adjustment of industrial structure, work with relevant departments to formulate industrial policies that are conducive to industrial energy conservation and emission reduction, and comprehensively use price policies such as step price, differential price, and punitive price, as well as financial and tax support, Green finance and other means will promote the green transformation of traditional industries and the development of energy-saving industries.
Departments of industry and informatization at all levels should promote the inclusion of high-efficiency and energy-saving products and equipment in the government procurement list, and give priority to them in bidding for government investment and construction projects.
Article 9 The Ministry of Industry and Information Technology establishes mechanisms for the selection, evaluation and promotion of industrial energy-saving technologies and products, releases advanced applicable industrial energy-saving technologies, recommended catalogues of high-efficiency energy-saving equipment (products), and backward process technologies that do not meet mandatory performance standards. Accelerate the promotion and application of advanced industrial energy-saving technologies, processes and equipment, strengthen energy demand-side management in the industrial field, cultivate energy efficiency evaluation centers for the industrial industry, and promote the advancement of energy-saving technologies for industrial enterprises.
Encourage key energy-saving technology research and research and development of major energy-saving equipment, organize the implementation of energy-saving technology and equipment industrialization demonstration, and promote the development of energy-saving equipment manufacturing.
Article 10 The Ministry of Industry and Information Technology shall organize the formulation and timely revision of relevant standards for energy consumption per unit product, the energy efficiency of industrial energy equipment (products), and energy-saving technical specifications, and organize implementation and supervision.
Encourage local and industrial enterprises to formulate local industrial energy saving standards and enterprise energy saving standards that are stricter than national standards and industry standards.
Guide social organizations such as industry associations and industrial technology alliances to formulate group energy-saving standards based on the characteristics of the industry.
Article 11 The Ministry of Industry and Information Technology organizes the compilation of industrial energy efficiency guidelines, releases industrial energy efficiency-related indicators such as products (processes) in major energy-consuming industries, establishes industry energy efficiency level indicator systems and implements dynamic adjustments.
Article 12 The competent departments of industry and informatization at all levels shall, based on the state of industrial energy consumption and the development of industrial economy, study and propose the total industrial energy consumption control targets and energy conservation targets in their respective administrative areas, and implement target management.
Article 13 The competent departments of industry and informatization at all levels shall carry out relevant energy-saving examinations on the energy-saving evaluation reports of industrial enterprise fixed asset investment projects in accordance with their duties. For the projects that have passed the review, supervision after the event shall be strengthened, and the implementation of energy-saving measures shall be supervised and managed.
Article 14 The competent departments of industry and information technology at all levels shall regularly analyze the situation of industrial energy consumption and industrial energy conservation, and establish an industrial energy conservation situation research and judgment and industrial energy consumption early warning mechanism.
Article 15 The competent departments of industry and informatization at all levels shall establish education and training mechanisms for industrial energy-saving management personnel and professional and technical personnel, formulate educational training plans and outlines, and organize special education and job training.
Departments of industry and information technology at all levels shall carry out industrial energy conservation publicity activities and actively publicize industrial energy conservation policies and regulations, energy conservation technologies and advanced experience.
Article 16 The competent departments of industry and informatization at all levels shall cultivate the development of energy-saving service industries, support energy-saving service agencies to carry out industrial energy-saving consulting, design, evaluation, measurement, testing, audit, certification and other services, and actively promote contract energy management and energy-saving equipment Energy-saving mechanisms such as leasing, government and social capital cooperation models, and voluntary energy-saving agreements. Scientifically establish the initial allocation of energy use rights and carbon emission rights, and carry out related work on energy use rights and carbon emission rights trading.

The competent departments of industry and informatization of local people's governments at or above the county level shall organize and implement the supervision of industrial energy conservation in the region in light of the actual conditions in the region.
Article 18 The competent departments of industry and informatization at all levels shall strengthen the construction of energy-saving supervision teams and establish and improve energy-saving supervision systems.
The funds required by energy-saving supervision institutions are included in the fiscal budget at the same level in accordance with the law, supporting the improvement of hardware facilities, strengthening of capacity building, and business training. The implementation of energy-saving supervision shall not charge fees to the monitoring objects.
Article 19 The competent departments of industry and information technology at all levels shall organize energy conservation supervision agencies to implement the energy conservation laws and regulations of industrial enterprises, the implementation of mandatory unit energy consumption quotas and other mandatory energy conservation standards, and backward technology and equipment for energy use (Products) phase-out, implementation of energy-saving assessment and review opinions for fixed asset investment projects, and implementation of energy-saving laws and regulations by energy-saving service agencies.
The competent departments of industry and informatization at all levels shall clarify the key tasks of the annual industrial energy-saving supervision, and organize energy-saving supervision institutions to carry out joint inspections and remote inspections as needed.
The Ministry of Industry and Information Technology may entrust local energy-saving supervision agencies to carry out relevant special supervision tasks as required.
Article 20 Industrial energy-saving supervision shall mainly take the form of on-site supervision, and may take the form of written supervision when necessary. On-site supervision shall be carried out by two or more energy-saving supervisors, who may take surveys, take samples, take pictures, record videos, consult relevant documents and accounts, interview and inquire relevant personnel, and monitor the energy utilization of energy-using products, equipment and production processes. Article 21 An energy-saving supervision institution shall establish an industrial energy-saving supervision situation announcement system, regularly disclose the results of industrial energy-saving supervision, and actively accept social supervision.
Chapter IV Energy Conservation in Industrial Enterprises
Article 22 Industrial enterprises shall strengthen the organization and leadership of energy conservation and emission reduction, establish and improve energy management systems, formulate and implement corporate energy conservation plans, and improve energy efficiency.
Article 23 An industrial enterprise shall set up measurable and assessable annual energy-saving indicators, improve the system of rewards and punishments for energy-saving goals, clarify job target responsibilities, and strengthen incentives and constraints.
Article 24 Industrial enterprises implement classified measurement of various types of energy consumption, reasonably equip and use energy measurement instruments that conform to national standards, improve basic energy measurement capabilities, and ensure that the original data are true, accurate, and complete.
Article 25 An industrial enterprise shall identify energy statisticians, establish and improve original energy records and statistical ledger, strengthen energy data collection management, and submit relevant statistical data and information in accordance with regulations.
Article 26 Industrial enterprises shall strictly implement the compulsory standards such as national energy efficiency equipment (product) energy efficiency standards and unit product energy consumption quota standards, and prohibit the purchase, use, and production of energy consumption equipment (products) explicitly eliminated by the state. The energy-use technology, equipment (products) eliminated by the state explicitly are transferred or leased for use by others.
Article 27 Encourage industrial enterprises to strengthen energy-saving technology innovation and technological transformation, conduct research on energy-saving technology applications, develop key technologies for energy-saving, promote the transformation of energy-saving technological achievements, and adopt efficient energy-saving processes, technologies, and equipment (products).
Encourage industrial enterprises to create "green factories", develop and apply technologies such as smart microgrids, distributed photovoltaic power generation, waste heat and pressure utilization, and green lighting, and develop and use green, clean, and low-carbon energy.
Article 28. Industrial enterprises shall regularly conduct publicity and education on energy-saving policies and regulations and technical training for their employees.
Chapter V Energy Saving of Key Energy-using Industrial Enterprises
Article 29 Strengthen energy-saving management of key energy-consuming industrial enterprises. Key energy-using industrial companies include:
(1) Industrial enterprises with a total annual energy consumption of 10,000 tons of standard coal (equivalent to 80 million kilowatt-hours of electricity, 6800 tons of diesel, or 7.6 million cubic meters of natural gas);
(2) Total annual energy consumption of 5,000 tons of standard coal (respectively equivalent to 40 million kilowatt-hours of electricity, 3400 tons of diesel or 3.8 million cubic meters of natural gas) as determined by the provincial, autonomous region, and municipality ’s industry and information technology authorities is less than one Industrial enterprise of 10,000 tons of standard coal.
Article 30 The Ministry of Industry and Information Technology strengthens guidance and supervision on energy conservation management of key energy-using industrial enterprises nationwide.
Provinces, autonomous regions, and municipalities directly under the Central Government ’s industrial and information technology departments shall implement supervision and management of energy conservation for key energy-using industrial enterprises in their respective administrative regions.
Under the guidance of higher-level industrial and informatization departments, the competent industrial and informatization departments of the city and county-level people's governments with districts can implement territorial management of key energy-consuming industrial enterprises, and can determine other than key energy-consuming industrial enterprises based on actual conditions. Industrial enterprises carry out energy-saving supervision and management.
Article 31 Key energy-consuming industrial enterprises shall set up energy statistics, metering, technology, and comprehensive management positions based on the total energy consumption, the concentration of production sites, and the complexity of production processes. The senior management personnel of the above technical titles are responsible for energy management, forming an energy management organization system with posts, responsibilities and full participation.
The establishment of energy management posts and the appointment of the person in charge of energy management of key energy-using industrial enterprises shall be reported to the relevant industrial and information administration departments for the record.
Article 32 Encourage key energy-using industrial enterprises to carry out energy audits, and formulate energy-saving plans and energy-saving technological transformation plans for enterprises based on the audit results, and track and implement the implementation of energy-saving transformation projects.
Article 33 The key energy-using industrial enterprises shall submit the energy utilization status report of the previous year to the relevant industrial and informatization authorities. Energy utilization status report includes energy purchase, processing, conversion and consumption, unit product energy consumption, energy consumption of major energy-consuming equipment and processes, energy efficiency, energy management, energy-saving measures, energy-saving benefit analysis, completion of energy-saving targets, and energy Consumption forecasts and more.
Article 34 If the key energy-consuming industrial enterprises are unable to achieve the annual energy-saving targets, the relevant industrial and informatization competent authorities shall notify them.
Article 35 Key energy-consuming industrial enterprises shall actively fulfill their social responsibilities, and encourage key energy-consuming industrial enterprises to regularly release corporate social responsibility reports that include energy use, energy conservation management, and employee care.
Article 36 The key energy-consuming industrial enterprises shall carry out activities of benchmarking and achieving energy efficiency standards, establish energy efficiency benchmarks, formulate implementation plans, improve energy conservation management, implement major energy-saving technological transformation projects, and strive to create energy efficiency “leaders”.
Article 37 Encourage key energy-using industrial enterprises to build an energy management and control center system, use automation and information technology to implement dynamic monitoring and management of the production, transmission, distribution and consumption of enterprise energy systems, improve and optimize energy balance, and increase corporate energy Utilization efficiency and management level.
Article 38 Key energy-consuming industrial enterprises shall establish an energy management system, adopt advanced energy-saving management methods and technologies, improve the management of the entire process of energy utilization, and promote the construction of energy-saving culture in enterprises.
Chapter VI Legal Liability
Article 39. The competent authorities of industry and information technology at all levels and relevant departments shall, in accordance with their functions and powers, order industrial enterprises in any of the following circumstances to be ordered to make corrections within a specified period of time and to be suspended according to laws and regulations such as the Energy Conservation Law of the People's Republic of China Equipment, warnings, fines, etc., and made public:
(1) The energy consumption does not meet the mandatory energy consumption quotas and energy efficiency standards;
(2) Energy statistics and energy measurement do not meet the relevant national requirements;
(3) Fraudulent energy data;
(4) producing and using high energy-consuming and backward energy-using products, equipment and processes eliminated by the state's explicit order;
(5) Other situations in violation of energy conservation laws and regulations.
Article 40 Staff members of the competent industrial and information technology departments at all levels and energy-saving supervision agencies shall be punished according to law if they have one of the following circumstances in the management of industrial energy-saving; if they constitute a crime, they shall be investigated for criminal responsibility according to law:
(1) Disclosure of the company's technical secrets or business secrets;
(2) Making use of the convenience of his position to seek illegal benefits;
(3) Collecting fees illegally;
(4) Those who abuse their powers, neglect their duties, and engage in malpractices for personal gain.
Chapter VII Supplementary Provisions
Article 41 The competent departments of industry and informatization of local people's governments at or above the county level may formulate specific implementation measures based on these measures and local conditions.
Article 42 These Measures shall be implemented as of June 30, 2016.
